Following our previous email on April 1, 2023, we would like to provide you with the most updated information on the New Trademark Law according to the guideline issued by the Myanmar IDP on April 5, 2023:

Based on the latest updates, we would like to recommend the following necessary actions to prepare for the Grand Opening Day of the New Trademark Law:

Please be strongly noted that, failure to the deadlines set forth, the re-filed applications will be deemed as abandoned from registration, according to the New Trademark Law and its regulations.

We are committed to providing you with the most up-to-date information, reliable advice, and prompt actions, in order to ensure the trademark application filings will be completed on time, allowing your clients to enjoy the Grand Opening date as the earliest filing date.

緬甸知識產(chǎn)權(quán)局公布最新的商標(biāo)法于2023年4月1日正式實施。新的《2019年商標(biāo)法》實施的“過渡期”是2020年10月1日至2023年3月31日；目前緬甸官方公布，在此基礎(chǔ)上再增加一個短期的第二階段“過渡期”，即2023年4月3日至2023年4月25日，以便更有利于在先申請人的知識產(chǎn)權(quán)保護。

在兩個“過渡期”內(nèi)，所有以前在登記制度下遞交登記的商標(biāo)以及即將在緬甸使用的商標(biāo)都可以重新遞交申請，早申請優(yōu)先保護。如果在兩個“過渡期”都沒有申請的商標(biāo)，可以從2023年4月26日開始，直接遞交申請，所申請商標(biāo)受新的商標(biāo)法保護，遵循新的商標(biāo)申請程序，按照新的商標(biāo)法要求提供所需資料。

另外需要注意的是，在“過渡期”遞交申請的商標(biāo)，要求在規(guī)定的期限內(nèi)及時補充遞交經(jīng)過公證的TM2表格，并繳納官費；否則所有申請視為放棄，所申請的商標(biāo)無效。所以優(yōu)創(chuàng)信諾在這里提醒大家，盡快補充所需資料繳納相關(guān)費用，讓重新遞交的申請真正進入有效狀態(tài)，最終獲得法律的保護，為企業(yè)開拓緬甸市場助力。
